We reserve our right to refuse service to anyone for any reason. Our desition is allways final. Code The program uses Microsoft distributed libraries and is meant to be run on a Windows XP platform. Caracolix Media Group claims full ownership of ArtDesk software, trade name and code. Violations to International Copyright Laws will be enforced to the full extent. All costs incurred to enforce this Copyright will be paid by the violating party. Caracolix attorneys will seek full compensation in this matter. Software Safety Before being released to the public, ArtDesk software was fully tested and it is completely operational as designed in any Windows XP equipped environment. It may also run in other, previous, Windows versions but it was not tested by Caracolix Media and it is not guaranteed to operate properly. Software Minimum Requirements * Windows XP operative system * An Internet connection * Mouse * 600 x 800 or 1024 x 768 screen resolution * 64 MB of memory * 1 MB free hard drive space Service Provision To Members Members are artwork authors or they legal representatives who wish to publish their artwork through ArtDesk. ArtDesk downloads members artwork to users computers and updates their desktop wallpaper with the downloaded image. Members acknowledge and authorizes Caracolix Media Group to accomplish this job trough ArtDesk without any permission in writing. All authors or their representatives signing up for membership acknowledge to these terms and any other regulations appearing on or before the submission form. By submitting an image link for inclusion on ArtDesk databases, members, release Caracolix Media Group and ArtDesk of any liability they may claim for use of their copyrighted material and grant full permission for the use of such artwork on ArtDesk displays and in the user computer display. A valid personal email address is mandatory for membership. Membership will be validated after email confirmation. Members can request only one membership. If for any reason more than one membership is needed for the same individual, contact support at artdesk.info@caracolix.com before filling a new membership form. Currently we do not run a member's mailing list. However if we need to inform our members about importante changes or additions to the service, the supplied email address will be used for contacting. All email addresses and member's information is private and confidential. That information is to be used only by Caracolix and ArtDesk, it will not be made available to the public nor to any third party unless mandated by law. To Users Users of ArtDesk software are not required to pay for it use nor for any additional services. Membership only applies to artwork providers not to users. Caracolix Media Group and ArtDesk make no representation nor endorses their members. In the event of a dispute between an user and a member, ArtDesk will mediate between the involved parties to reach a fair and just solution. ArtDesk and Caracolix Media Group are not liable in any way for damages or actions taken by members or any other third party in addition to others as stated on the disclaimer and elsewhere. Service is provided to any individual or group without restrictions on the nationality, color, income level, age, race, etc. as long as it does not interfere with our other providers terms of service. Currency United States Dollars are used wherever currency is displayed. Liabilities ArtDesk only liability is providing the safest environment of operations as possible under their reach for all involved parties. Whether it involves the software, their remote servers, payment collection and claims handling. Members are liable for providing a good service to their customers and to ArtDesk users in general. Members must make available for download their submitted artwork images. They must inform ArtDesk of any changes on their links, contact information, services and pricing ahead of time. Broken links are not tolerated and in such a case membership is instantly forfeit without advice. Users are responsible to have a working Internet connection for ArtDesk to work properly. ArtDesk does not provide connection to the Internet nor can magically retrieve images without one. Privacy: Applicable to members (authors, sales representatives, copyright holders) and users. All personal information supplied by members and users is solely used by Caracolix Media to fulfil the applicable business being conducted with the individual or individuals involved on the transaction being conducted. No personal, information is shared between any party unless it is necessary to complete a transaction as specified elsewhere on this document or in other documents posted on Caracolix domain. We do not collect personal information other than what is necessary to complete a sale(whether applicable) and such information is kept private and confidential and in no event is being sold, shared nor published elsewhere unless mandated by law. We reserve the right to change or modify these terms at any time without advice.
